Indes bezweckt das deutsche Strafrecht mit den Korruptionsstraftatbeständen primär das Vertrauen in die Integrität der Amts- und freien Mandatsausübung staatlicher Funktionsträger zu schützen. Der nachfolgende Beitrag tritt dafür ein, auch die Menschenrechte als schutzwürdige Rechtsgüter i.R.d. Korruptionsstraftaten anzuerkennen. Dies gilt nicht zuletzt deshalb, da sich Deutschland auch auf internationaler Ebene zur Bekämpfung von Korruption bekennt und den insoweit abgeschlossenen Abkommen u.a. der Schutz der Menschenrechte zu Grunde liegt. | ||

Therefore, it violates the principle of equality. However, also basic freedom rights can be violated. Meanwhile, German criminal law focuses with the corruption offenses primarily on the trust in the integrity of the official and the free exercise of mandate by state officials. The following article argues for recognizing human rights as legal interest in the context of corruption crimes. This applies not least because Germany has committed itself to fight corruption on international level and the respective agreements concluded are based, among other things, on the protection of human rights. | ||
