Summary:	The present study aims to evaluate whether the treatment performed in psychiatric hospitals, in the execution of the mental heath treatment, is, in fact, adequate, suggesting that the practice of institutional violence in the execution of the measures, makes them similar to a penalty, itself. The work seeks to present the disparities between penalty and mental heath treatment and to point out points of convergence between both. More specifically, this article also aims to expose that the security measure can be, even more severe, than the application of an eventual penalty, considering that there is no established time for its duration. In addition, the modification brought by Law 13.964 / 19 will be analyzed, which extended the time of serving time in the Brazilian legal system to 40 (forty) years and its implications in the execution of the security measure. Thus, through doctrinal research, the aim is to analyze the process of building madness as a mental illness and the formulation of social control mechanisms. O presente estudo tem por objetivo avaliar se o tratamento realizado nos hospitais psiquiátricos, na execução da medida de segurança é, de fato, adequado, trazendo como hipótese que a prática da violência institucional na execução das medidas, as fazem sersemelhantes à uma pena, propriamente dita. O trabalho busca apresentar as disparidades entre pena e medida de segurança e apontar pontos de convergência entre ambas. Mais especificamente, o presente artigo objetiva, também, expor que a medida de segurançapode ser, ainda mais severa, do que a aplicação de uma eventual pena, considerando que não existe um tempo estabelecido para sua duração. Ademais, será analisada a modificação trazida pela Lei 13.964/19 que ampliou o tempo de cumprimento de pena no ordenamento jurídico brasileiro para 40 (quarenta) anos e suas implicações na execução da medida de segurança. Assim, por meio da pesquisa doutrinária, visa-se analisar o processo de construção da loucura como doença mental e a formulação dos mecanismos de controle social.
