Si bien la función judicial, en aras de su independencia, por regla general ha de contar con una fuerte restricción a la responsabilidad por las consecuencias que se derivan del ejercicio de dichas funciones, en situaciones en las que se incurra en graves vicios en la impartición de justicia se justifica hacer excepción a aquella regla. El artículo analiza diversos patrones y casos ocurridos durante la dictadura chilena, tanto en la Justicia militar como en la ordinaria, identificando en ambos casos un vicio en el desempeño de la función judicial, relevante para fundamentar la antijuridicidad de la conducta, y examinando las diversas modalidades de intervención penalmente imputables. Se concluye que, respecto de diversas constelaciones fácticas, los comportamientos de los jueces chilenos, más allá de las hipótesis de simple encubrimiento, representan formas de intervención punible en los homicidios, secuestros y torturas perpetrados por terceros, a título de inducción o autoría mediata activas o, de forma más extendida, a título de autoría omisiva o, a lo menos, de complicidad por omisión. | ||

Although the judicial function, for the sake of its independence, as a rule must have a strong restriction on liability for the consequences arising from the exercise of such functions, in situations where there are serious flaws in the administration of justice it is justified to make an exception to that rule. The article analyzes various patterns and cases that occurred during the Chilean dictatorship, both in the military and in the ordinary courts, identifying in both cases a defect in the performance of the judicial function, relevant to establish the unlawfulness of the conduct, and examining the various modes of criminal liability applicable. | ||
