Hence, a national normative corpus that exceeds the territoriality of said legal systems has begun to develop. It is the UK's Modern Slavery Act, one of the clearest examples. The scope of lege lata and lege ferenda that such legislation can achieve, as well as its comparison with the regime for preventing corruption and money laundering in the framework of international business, are the purposes of this research. Thus, our thesis advocates for creating an omission crime concerning those administrators and managers of multi-national corporations, when they intervene in said situations of labour exploitation through the breach of (qualified) duties of solidarity. | ||
| 520 | |a Una de las peores manifestaciones de la trata de seres humanos en el ámbito de la explotación laboral se halla en la cadena de suministros de empresas multinacionales. Su prevención es tanto competencia del Derecho internacional (por referirse a violaciones sistemáticas a las normas de la OIT y de Naciones Unidas), como también del derecho penal nacional. De ahí que haya comenzado a desarrollarse un corpus normativo nacional que excede al de la territorialidad de dichos ordenamientos jurídicos; siendo la Modern Slavery Act del Reino Unido uno de los ejemplos más prístinos. El propósito de esta investigación es determinar el alcance de lege lata y de lege ferenda que, desde el punto de vista jurídico penal, puede lograr dicha normativa, así como su comparación con el régimen de prevención de la corrupción y del blanqueo de capitales en el marco de los negocios internacionales. En base a esto, se propone la creación de un tipo de omisión pura de garante respecto de aquellos administradores y/o responsables de multinacionales que intervengan en dichas situaciones de explotación laboral, mediante el incumplimiento de deberes de solidaridad cualificados. | ||
