Such questions have been intensively discussed by the courts all over the world during the last decades. This paper examines some of the most significant decisions by constitutional and supreme courts, as well as by the European Court of Human Rights, that in many cases have modified (or contributed to) the state of the law on euthanasia, for the sake of protecting the patient’s fundamental rights, even against the will of democratically elected legislators. | ||
| 520 | |a Toda regulación jurídica de las diferentes formas de eutanasia plantea necesariamente cuestiones de compatibilidad con los derechos fundamentales de las personas (el derecho a la vida, a la integridad física o a la salud, a la vida privada, al libre desarrollo de la personalidad, la autodeterminación terapéutica, etc.) y con el super-principio del respeto debido a su dignidad. Estas cuestiones han sido objeto, en las últimas décadas, de un intenso debate jurisprudencial en varios países del mundo. Este artículo analiza algunas de las decisiones más significativas de las cortes constitucionales o supremas, así como del Tribunal Europeo de Derechos Humanos, que en varios casos han modificado (o han contribuido a modificar) el derecho vigente sobre la materia, en nombre del respeto de los derechos fundamentales del paciente, considerados como no disponibles por el legislador democráticamente electo. | ||
