They frequently locate the forfeiture foundations in the Constitution, the statues or as a manifestation of the criminal law of the enemy. The purpose of this article is to give a different basis to this legal concept, from the outside of the legal system. It uses the anomy theory developed by Robert King Merton to state that forfeiture is in his essence a router of anomy, as it gives mayor emphasis to the procedure than to its social goals. | ||

La mayoría de los planteamientos que se han hecho en la materia fundamentan al instituto desde dentro del sistema comoquiera que lo ubican como una figura constitucional, penal o simplemente como un instrumento del derecho penal del enemigo. En este escrito se pretende, en cambio, darle una fundamentación exógena anclada a la teoría de la anomia de Merton, dado que se encuentra como el instituto bajo estudio es un corrector de anomia pues pretende hacer hincapié en los medios lícitos permitidos por la sociedad y no tanto en los fines. | ||
