The Law regulates the responsibility of persons over 14 and under 18, and imposes «measures» (not penalties) that are applied with great flexibility. The direction of the procedure is placed in the hands of the prosecutor, not the judge.La Ley (LO 5/2000, de 12 enero, modiicada parcialmente por LO 8/2006, de 4 de diciembre), que regula la responsabilidad del menor, es una Ley garantista que sustituye la orientación paternalista de la Ley de 1948 de los Tribunales Tutelares de Menores, por un régimen no represivo sino sancionador-educador. Su objetivo final es primar el «interés superior del menor», que ha de evaluar un equipo técnico, profesional, especializado y pluridisciplinar. La Ley regula la responsabilidad de los mayores de 14 años y menores de 18, e impone «medidas» (no penas) que se aplican con gran flexibilidad.
