En esta obra, a partir del análisis de la solidaridad mecánica, el autor dedicó un gran espacio al tratamiento de la cuestión criminal, del crimen y del castigo, desde una perspectiva verdaderamente sociológica. En este sentido, el principal objetivo del presente artículo consiste en realizar un análisis de dicha obra teniendo en cuenta el planteamiento de Durkheim acerca del derecho, el delito y la pena dando cuenta de las similitudes y diferencias respecto de teorías criminológicas anteriores y contemporáneas. La importancia de este autor en el estudio de estos fenómenos radica en que propone una explicación social así como también una visión desesencializadora del delito que rompe con las teorías criminológicas anteriores en un momento donde la economía política y las escuelas positivistas se centraban en las explicaciones individualistas. A este respecto, si bien se trata de un autor positivista, este positivismo solo se manifiesta en su sociología y no en sus definiciones del delito y la pena. De esta manera, Durkheim constituye la primera alternativa a la concepción biopsicológica del delincuente, propia del positivismo.One of Emile Durkheim´s (1858-1917) most outstanding works is The Division of Labour in Society (1893). In this book, whose starting point is the analysis of mechanical solidarity, the author devoted a considerable space to the treatment of criminal aspects, crime and punishment from a truly sociological perspective. In this respect, the objective of this article is to analyse Durkheim´s text from his own perspective on law, crime and punishment, comparing and contrasting it with previous and contemporary criminal laws. The importance of this author in these phenomena lies in the fact that he proposes both a social explanation and a view that explores the essence of crime. These viewpoints establish a turning point from earlier criminal theories at a time when political economy and positivist schools were centered on individualistic explanations. In this respect, though Durkheim is a positivist, this perspective is only made explicit in his sociology, not in his definitions of crime and punishment. In this way, Durkheim constitutes the first alternative to the bio-psychological conception of delinquent which is intrinsic to positivism.Fil: Sancho, María Dolores.
