There arises a questioning of the effectiveness of the laws that protect Colombian children, so this research aims to analyze from the lens of legal psychology the effectiveness of Article 199 of Law 1098 of 2006 –Childhood and Adolescence Law– in terms of guaranteeing rights to girls in Colombia in the light of the figures recorded during the period 2006 to 2018 in the area of child sexual abuse in the country and the feminicide of Yuliana Andrea Samboní Muñoz as an exponent of a new typology within this crime. From there it is concluded by reason of the analysis and articulation of the psychology of the testimony, the psychopathic personalities, specifically the compulsive personality in their psychotic dye and the effectiveness of the deprivation of liberty before people who hold such typology, that it is necessary to implement strategies preventive that allow society to become aware of the existence of profiles such as Rafael Uribe Noguera, a prestigious professional with no apparent need to commit a crime, but with a mental disorder that demands it. El momento en que un prestigioso arquitecto Bogotano se convierte en uno de los mayores referentes de crueldad y tortura en Colombia, da lugar a un punto de quiebre en los patrones de abuso sexual y feminicidio en el país. De allí surge un cuestionamiento a la efectividad de las leyes que protegen a la niñez colombiana, por ello la presente investigación pretende Analizar desde el lente de la psicología jurídica la efectividad del Artículo 199 de la Ley 1098 de 2006 –Ley de Infancia y Adolescencia– en materia de garantía de derechos a las niñas en Colombia a la luz de las cifras registradas durante el periodo 2006 a 2018 en materia de abuso sexual infantil en el país y el feminicidio de Yuliana Andrea Samboní Muñoz como exponente de una nueva tipología dentro de este delito. De allí se concluye en razón al análisis y articulación de la psicología del testimonio, las personalidades psicopáticas, específicamente la personalidad compulsiva en su tinte psicótico y la efectividad de las penas privativas de la libertad ante personas que ostentan dicha tipología, que es necesario implementar estrategias preventivas que permitan que la sociedad tome conciencia de la existencia de perfiles como el de Rafael Uribe Noguera, un profesional prestigioso sin necesidad aparente de delinquir, pero con un desorden mental que así se lo exige | ||
