| Summary: | Firstly, this report focuses on the perception of the judicial reality, focusing on the practical teachings learned during the internship. Secondly, the report focuses on the criminality analysis of domestic violence, aiming at understanding all procedural stages, as well as the existence of the right to refuse to testify that can be exercised applied to any procedural stage in which the victim has to provide statements. Faced with this prerogative, has developed the possibility of applying the regime of declarations for future memory to victims of domestic violence from the Law that develops the legal regime applicable to the prevention of domestic violence. In this case, the situa-tion should be taken into account whenever it is covered by the legal regime of declarations for future memory, anticipating the production of evidence that should be valued at a trial hearing.O presente relatório debruça-se, numa primeira fase, sobre a percepção da rea-lidade judiciária, focando-se os ensinamentos práticos obtidos no decorrer do estágio. Num segundo momento, o relatório incide na análise do regime do crime de violência do-méstica, visando a compreensão de todas as fases processuais, bem como a existência de um direito de recusa de depoimento que pode ser exercido em qualquer fase processual em que a vítima tenha de prestar declarações. Face a tal prerrogativa, desenvolveu-se a possibilidade da aplicação do regime das declarações para memória futura às vítimas de violência doméstica, a partir da Lei que pre-vê o regime jurídico aplicável à prevenção da violência doméstica, sendo tomado em aten-ção o instituto sempre que se trate de uma situação abrangida pelo regime das declarações para memória futura, antecipando-se a produção de prova que deve ser valorada em audiência de julgamento
