AB En el presente trabajo se valora, desde el pensamiento crítico, las condiciones que llevan a la crisis socio-ambiental actual y la propuesta de utilizar el poder punitivo como un mecanismo de «solución» a la misma. En una primera parte se valora cómo el modo de producir que vertebra la modernidad condiciona el surgimiento y agudización de la crisis social y ambiental que amenaza con destruir la propia vida en la tierra. En un segundo momento se valora el poder punitivo como propuesta de solución a la problemática en cuestión y las verdaderas consecuencias que tal recurso trae a la realidad social. El propósito que mueve el discurso no es encontrar respuesta sino cuestionar las soluciones planteadas.
AB In the present work it is valued, from the critical thought, the conditions to take to the current socio-environmental crisis and the proposal to use the punitive power as solution mechanism to the same one. In a first part it values how that the way to produce to shape the modernity conditions the emergence and intensification of the social and environmental crisis that threatens to destroy the own life in the earth. In a second moment  the punitive power is valued as solution proposal to the problem in question and the true consequences that such a solution brings to thesocial reality. The purpose that moves the speech is not to find answer but to question the outlined solutions.
