AB O presente artigo visa a estudar a revitimização de meninas e mulheres vítimas de estupro levada a efeito por meio do funcionamento machista das instituições de justiça. Para tal, partiremos da análise de três acórdãos de tribunais de justiça estaduais selecionados como exemplo da reprodução do discurso patriarcal por essas instituições, apontando alguns dos modos pelo qual a mentalidade patriarcal transparece em seu conteúdo. Desse modo, pretendemos trazer luz a algumas formas de atuação do chamado “patriarcalismo jurídico” e dos mecanismos violentos pelo qual o judiciário (re)produz valores patriarcais.
AB This article aims to study the re-victimization of women and girls who are victims of rape that happens by the means of the sexist carrying of the legal institutions. For such, we will depart from the analysis of the rulings on three cases decided by Estate Courts selected as examples of the reproduction of the patriarchal discourse by these institutions, pointing out some of the ways by which the patriarchal mentality shows through in their contents. In this manner, we intend to bring light upon some forms of operation of the so-called “legal patriarchalism” and the violent mechanics through which the Legal System (re)produces patriarchal values.
