| Summary: | The aim of this paper is to draw a general outline of the present state of affairs of critical criminology in Germany. Critical criminology consists of those contributions which consider criminality, criminals and the penal law as being socially constructed facts, thus analysing the various processes of definition at various levels. The theoretical claim consists in the expectation that the situational aspects of the definition processes as well as the structural aspects of the allocation of resources and power will be thematized. From the point of view of criminal policy, this approach is generally characterized by a critical view of the status-quo. In this paper an explanation is given of the scientific achievement of this approach so far, some new trends such as dealing with the history of the penal law and social control, the abolitionist discussion, the contributions to the "paradigm of the settlement of conflicts" and the attempts at achieving a "realistic" criminal policy. These contributions are discussed from an immanent point of view. |
