Then the question will be part of the new Spanish criminal justice system criminal of legal persons, without forgetting the impact that the issue may have for individuals. Finally it will be answered the question about the design that have to have these procedures if it is desired to obtain from them the benefits expected of a criminal decision. | ||
| 520 | |a La creciente pretensión de los poderes públicos de convertir a los ciudadanos en informantes (whistleblowers) del Estado incentivando que denuncien aquellos delitos de los que puedan tener conocimiento es un rasgo característico de la política criminal contemporánea. El artículo se aproxima a dicho fenómeno y analiza sus orígenes, su tratamiento en otros países que tienen ya una cierta tradición en su utilización y su creciente expansión internacional. Posteriormente se enmarcará la cuestión en el nuevo sistema jurídico-penal español de responsabilidad penal de las personas jurídicas, aunque sin olvidar las repercusiones que el tema puede tener para las personas físicas. Finalmente se dará respuesta a lacuestión acerca del diseño que han de tener estos procedimientos si pretende obtenerse de ellos los beneficios esperados en caso de imputación o condena penal. | ||
