| Summary: | With the accelerated process of globalization the world today has become complex and the society increasingly unpredictable necessarily making life situations in uncertain and unpredictable. This unpredictability just making the people feel insecure and fear is a natural feeling. However, the intensification of those feelings caused by the increase of visible crime and,especially,by a reality created by the mass media, causes panic spread in the community and people startto press the authorities to attenuated their feelings of insecurity and fear. It happens that the means chosen for this decrease the feeling of insecurity are often the relativization guarantees of the penal system and increased more punishment, which ends on the one hand, not solving the issues of increased crime and, on the otherhand, wounding fundamental rights of all involved, straddling the symbolic function and the illusion that the criminal justice system has nowadays. Com o processo de globalização acelerado o mundo atual se tornou complexo e a sociedade cada vez mais imprevisível, tornando necessariamente as situações da vida em incertas e imprevistas. Esta imprevisibilidade acaba fazendo com que a população se sinta insegura e o medo seja um sentimento natural. Porém, a intensificação desses sentimentos provocada pelo aumento da criminalidade visível e, principalmente, por uma realidade criada pela mídia de massa, faz com que o pânico tome conta da coletividade e esta passe a pressionar as autoridades para que as sensações de insegurança e medo sejam atenuadas. Ocorre que os meios escolhidos para essa diminuição da sensação de insegurança são muitas vezes a relativização de garantias do sistema penal e o aumento do punitivismo, o que termina, por um lado, não resolvendo as questões do aumento da criminalidade e, por outro, ferindo direitos fundamentais de todos os envolvidos, escancarando a função simbólica e de ilusão que o sistema penal tem na contemporaneidade. |
