AB O presente artigo aborda temas que fundamentam o direito à reeducação, instituto que possui como base legal os direitos dos presos e as assistências previstas na Lei de Execução Penal. Por meio de uma pesquisa bibliográfica, foi possível expor as principais teorias sobre os fatores de condicionamento criminoso, sobre a reincidência criminal e sobre as finalidades das penas apontadas pela doutrina, buscando-se conceituar, por fim, o direito à reeducação que a função reintegrativa da pena estabelece.  Por fim, chegou-se a conclusão de que a função reintegrativa da pena, apesar das dificuldades encontradas, é a que melhor se coaduna com o Estado Democrático de Direito e que se mostra mais adequada para o enfrentamento da reincidência e para a promoção da justiça social.
AB This  article  discusses  issues  that  underlie  the  right  to  re-education  institute that  has  as  its  legal  basis  the  rights  of  prisoners  and  the  assistance  provided  for  in  the Law  of  Penal  Execution.  Through  a  literature  review  ,  it  was  possible  to  explain  the main  theories  of  criminal  conditioning  factors  on  recidivism  and  on  the  purposes  of penalties identified by the doctrine , seeking to conceptualize ,  finally  , the right to  re-education  that  reintegrative  function  pen  sets  .  Finally,  came  toconclusion  that  the reintegrative function of the penalty, despite the difficulties encountered, is the one that best  satisfiesthe  democratic  rule  of  law  and  to  show  more  suitable  to  face  the recurrence and the promotion of justice social.
