Nesse contexto, identifica-se na nossa realidade uma proeminência cada vez maior dos chamados poderes selvagens, em detrimento dos direitos fundamentais constitucionalmente assegurados, de forma semelhante ao que Garland identificou em sua análise da realidade americana e inglesa nas últimas décadas do século passado, em período de crise do modernismo penal, a qual culminou em, por um lado, um expansionismo penal segregacionista e, por outro lado, no descrédito nas instituições públicas, fortalecendo ainda mais os poderes selvagens em franca atuação, o que é especialmente problemático em nosso país, considerando nosso histórico repressivo, nossa fragilidade democrática e a imensa dificuldade que temos em lidar com o abismo social que nos separa, e que a tantos exclui. | ||
| 520 | |a The present study is part of the theme of social and institutional control of the crime, seeking to carry out a criminological analysis of contemporary Brazilian reality from the perspective of Ferrajoli 's criminal garantism, based on the study of the American criminologist David Garland. In this context, an increasing prominence of the so-called savage powers is being identified in our reality, to the detriment of the fundamental rights constitutionally assured, in a similar way to what Garland identified in his analysis of the American and English reality in the last decades of the last century, in crisis of criminal modernism, which culminated in segregationist penal expansionism on the one hand and, on the other hand, in the discrediting of public institutions, further strengthening the wild powers in full swing, which is especially problematic in our country, considering our repressive history, our democratic fragility and the immense difficulty we have in dealing with the social abyss that separatesus, and which excludes so many. | ||
