| 520 | |a This article aims to systematize the criticisms directed at Juvenile Criminal Law through the conceptual analytic dogmatic method, using the doctrinal concepts of both the Criminal Law and the Law of the Child and the Adolescent, analyzing how they are relating. After the presentation of the main foundations and theoretical references of Juvenile Criminal Law, the criticisms are divided into two levels: ideological and methodological-scientific. With this didactical result of distinguishing critical levels, it is concluded by the methodological-scientific approach that it is a misnomer to rank the connections involving the Criminal Law and a part of the Law of the Child and the Adolescent, especially that which refers to the infractions acts and to the socioeducatives measures, in a microsystem, as being a Juvenile Criminal Law. | ||
| 520 | |a O presente artigo tem por objetivo sistematizar as críticas dirigidas ao Direito Penal Juvenil através do método dogmático analítico conceitual, utilizando-se, pois, os conceitos doutrinários tanto do Direito Penal quanto do Direito da Criança e do Adolescente, analisando como eles se relacionam. Após a exposição dos principais fundamentos e referenciais teóricos do Direito Penal Juvenil, as críticas são divididas em dois planos: ideológico e metodológico-científico. Com esse resultado didático de distinção dos planos críticos, conclui-se, pelo enfoque metodológico-científico, que é um equívoco classificar as conexões envolvendo o Direito Penal e uma parte do Direito da Criança e do Adolescente, notadamente a que se refere aos atos infracionais e às medidas socioeducativas, em um microssistema, como sendo um Direito Penal Juvenil. | ||
