While the affected person seems to have no role in that, doubts begins when it also violates a rule. It is unclear the kind of conflict, how to solve it and what effects it has. From a practical and dogmatic basis the study seeks to answer such questions. Solutions are discussed with a specific proposal, from the normative point of view and attending real events (avoiding hypothetical considerations). From general regulated effects, the paper presents the main national jurisprudential trends and then makes a dogmatic analysis from a specific normative perspective. This test is presented with a known case by the fame of the accused that somehow appears as a guide. | ||
| 520 | |a Uno de los problemas de mayor incidencia práctica, y poco atendido, es la influencia del comportamiento prohibido del propio afectado en la determinación de responsabilidad del autor. Si bien la víctima parece no tener rol alguno, las dudas comienzan cuando ella también infringe una norma. No es claro qué clase de conflicto es, cómo se soluciona y qué efectos tiene. Desde una base práctica y dogmática se busca responder tales cuestiones. En este estudio se debaten criterios de solución y se plantea una propuesta específica desde el punto de vista normativo, con atención a los sucesos realmente acaecidos (que evita consideraciones hipotéticas). A partir de los efectos generales regulados del comportamiento de la víctima, el trabajo expone las principales tendencias en jurisprudencia nacional para luego realizar una reflexión dogmática conforme una específica perspectiva de análisis jurídico. Este examen se presenta con un conocido caso por la fama del imputado que, de algún modo, aparece como hilo conductor. | ||
