La legislación comparada muestra una tendencia a punir en forma separada los delitos de posesión de armas y municiones de aquellos que suponen su porte sin autorización, en algunos casos con penas más graves para este último y en otros casos con las mismas penas. La legislación chilena opta por esto último, presentándose ciertas dificultades a la hora de aplicar los tipos penales especialmente en lo que dice relación con la delimitación del objeto material y la puesta en riesgo del bien jurídico, así como con la determinación de la pena en aquellos delitos en los que se ha hecho uso de un arma de fuego. Se estudian estos aspectos con base en doctrina y jurisprudencia. | ||

The comparative legislation shows a tendency to punish separately the crimes of possession of firearms and ammunition and illegal carrying firearms, in some cases with higher penalties for the latter, and in other cases with the same penalties. The Chilean legislation adopted the latter system, presenting certain difficulties in applying criminal offences, especially with the delimitation of the material object and the risk of the legal good, as well as the determination of the penalty in those cases crimes in which a firearm has been used. These aspects are studied based on legal theory and jurisprudence. | ||
