Después de casi ciento veinticinco años en que tal regulación permaneció prácticamente intacta, fue radicalmente modificada por la Ley N° 19.645, de 11 de diciembre de 1999. Tres años después, volvió a sufrir cambios por la Ley N° 19.829, de 8 de octubre de 2002. Siete años después, fue modificada por la Ley N° 20.341, de 22 de abril de 2009. Cinco años más tarde, volvió a ser modificada por la Ley N° 20.730, de 8 de marzo de 2014. Y cuatro años después, volvió a sufrir cambios por la Ley N° 21.121, de 20 de noviembre de 2018. En este trabajo, después de resumir el contenido de cada uno de esos cambios legales, se examinan las principales modificaciones al delito de cohecho efectuadas por la última de dichas leyes. Dentro de estas modificaciones, se realiza una distinción entre aquellas que merecen una valoración positiva, aquellas que merecen una valoración negativa y aquellas que originan nuevos problemas interpretativos. | ||
| 520 | |a Over the last twenty years, the legislature has amended the regulation of the crime of bribery several times, which does not seem advisable for legal certainty. After almost one hundred and twenty-five years in which such regulation remained practically intact, the legislature modified it radically with Law No. 19,645 of 11 December 1999. Three years later, the legislature changed it again with Law No. 19,829 of 8 October 2002. Seven years later, this regulation was again amended by Law No. 20,341 of 22 April 2009. Five years later, the legislature amended it again with Law No. 20,730 of 8 March 2014. And four years later, one more time, this regulation was modified by Law No. 21,121 of 20 November 2018. In this article, after summarizing the content of each of these legal changes, we examine the main modifications to the crime of bribery made by the last of these laws. Within these modifications, a distinction is made between those that merit a positive evaluation, those that merit a negative evaluation and those that give rise to new interpretative problems. | ||
