En particular, debe tratarse de una persona débil, que realiza una actividad respetable al momento de ser victimizada, y que no puede ser responsabilizada por el sitio donde ocurrió el hecho. A partir de ahí, este artículo explora las prácticas y narrativas que se despliegan en el sistema penal chileno y que permitirían afirmar la influencia de una "víctima ideal" cuando procesa casos de trata (human trafficking). Para ello, se aplicó una metodología cualitativa que consideró como principales técnicas de recolección de datos la revisión documental, la realización de entrevistas semiestructuradas a operadores del sistema penal y el análisis de contenido de las sentencias dictadas durante el periodo 2011-2020. Sobre esta base, el artículo concluye que, para que la persona afectada sea considerada como una víctima de trata, es necesario que cumpla un estándar construido socialmente a partir de estereotipos y prejuicios asociados a la prostitución y la inmigración irregular. | ||

This article explores the practices and narratives developed in the Chilean penal system that give relevance to the construction of the "ideal victim" in the field of human trafficking. For this purpose, a qualitative methodology was applied, which considered as main data collection techniques the documentary review, semi-structured interviews with operators of the penal system and content analysis of sentences issued from 2011 to 2020. On this basis, the article concludes that, for the affected person to be considered a victim of trafficking, it is necessary that they meet a socially constructed standard based on stereotypes and prejudices associated with prostitution and irregular immigration. | ||
