Most comparative legal systems now provide for criminal offenses targeting the production, distribution, and possession of child pornography. What does represent a relatively modern phenomenon, however, is the self-production of pornography, that is, cases in which the production of pornographic records is under the control of the person who appears in them, so that she directs the process of production of the content. In this context, the purpose of this article is to analyse the possibility of applying the child pornography criminal offences regulated by the Chilean Criminal Code to cases of self-production of child pornography. | ||
| 520 | |a La pornografía infanto-juvenil no es ciertamente un fenómeno reciente en nuestra sociedad. Actualmente, la mayoría de los sistemas jurídicos comparados incorpora delitos relativos a la producción, distribución, y almacenamiento de pornografía infanto-juvenil. Sin embargo, lo que sí representa un fenómeno relativamente moderno es la autoproducción de pornografía, esto es, casos en que la elaboración de los registros pornográficos está controlada por la misma persona que aparece en ellos, de modo tal que ella domina el proceso de producción del contenido. En este contexto, el presente trabajo tiene por finalidad analizar la posibilidad de aplicar los delitos de pornografía infanto-juvenil establecidos en el Código Penal chileno a los casos de autoproducción de este tipo de pornografía. | ||
