En una primera parte, se examina la operatividad del delito de desobediencia del artículo 556.1 del Código Penal español ante el incumplimiento de esta clase de medidas, definiendo previamente los elementos esenciales de este tipo penal y confrontándolos con los de la correlativa infracción administrativa del artículo 36.6 de la Ley de seguridad ciudadana. En una segunda parte, se propone la introducción en la legislación española de un delito contra la salud pública específicamente previsto para afrontar situaciones de crisis sanitaria, tomando como modelo el delito contenido en el artículo 318 del Código Penal chileno. | ||
| 520 | |a The purpose of this article is to analyze the possibilities that, both from a lex lata perspective and from a lex ferenda one, Spanish Criminal Law has when it comes to punish the breach of measures provided to face health crises, paying special attention to cases related to the COVID-19 pandemic. In a first part, the operativity of the crime of disobedience of article 556.1 of Spanish Penal Code in front of the breach of this kind of measures is examined, with a previous definition of the essential elements of this criminal offence and a comparison with the correlative administrative infraction of article 36.6 of the Citizen Security Law.
