La nueva regulación extiende de forma sustancial los términos de la prescripción del delito en supuestos de victimización de menores y prevé, para determinados delitos especialmente graves, la suspensión del dies a quo hasta el momento en que la víctima alcanza la edad de treinta y cinco años. La reforma no resulta sorprendente si se atiende a procesos legislativos similares que se observan en el Derecho comparado y que son coherentes con las recomendaciones contenidas en distintos instrumentos internacionales. Sin embargo, el retorno al fundamento del instituto prescriptivo y el análisis pormenorizado de la nueva regulación permiten una reflexión crítica sobre la reforma e instan a idear vías complementarias para atender los derechos y las necesidades de las víctimas. | ||
| 520 | |a This paper analyses the reform of the Statute of limitations regulation for crimes involving children. The legal reform was incorporated in Spain trough the enactment of the Organic Law 8/2021, June 4th, addressing the protection of children and adolescents against violence. The new regulation substantially expands the terms of the statute of limitations and provides for the suspension of the dies a quo until the victim reaches the age of thirty-five for certain particularly serious offences affecting children. The reform is in line with similar regulations developed in other countries, which are consistent with various international instruments. However, revisiting the foundation of the prescriptive institute allows for a critical reflection on the legal reform and encourages the development of complementary measures to address the rights and needs of victims. | ||
