AB A  realidade carcerária  brasileira  passou  por  profundas  mudanças  nas  últimas décadas  e  pouco  se  tem  estudado  o  reflexo  na  ciência  do  direito.  Dentre  essas transformações, surgiram os estabelecimentos penais federais de segurança máxima, que são amplamente contestados sob o enfoque dos direitos fundamentais. Neste trabalho, são discutidas formulações teóricas e decisões judiciais nacionais e estrangeiras referentes ao cumprimento   da   pena   em   presídios   de   segurança   máxima.   Constrói-se   hipótese consistente na interpretação de que o Sistema Penitenciário Federal constitui mecanismo do  federalismo  cooperativo  e  na  reafirmação  do  dever  do  Judiciário  de  articular  sua argumentação,  com  princípios  e  standards  probatórios,  de  forma  a  tentar  limitar  seus erros.
AB The brazilian prison situation has undergone profound changes in the last decades and little has been studied about the reflection in Law. Among these transformations, there are the federal super maximum-security facilities, which are widely refuted under the fundamental rights approach. In this work, we discuss theoretical and judicial formulations, national and foreign judgments regarding the confinement in supermax prisons. We construct hypothesis which consists in the interpretation that the Federal Penitentiary System constitutes a mechanism of cooperative federalism and in reaffirming the duty of the Judiciary to articulate its argumentation, with principles and standards of proof, in order to try to limit its errors.
