| 520 | |a Tendo em vista que os projetos de reforma do sistema de justiça criminal perpetuam, reproduzem e reforçam a lógica punitiva, as pesquisas que visam a resolver algum tipo de problema pertencente a esta estrutura podem ser classificados como estudos de "ciência normal", em apropriação de expressão cunhada por Thomas Kuhn, físico e filósofo que estudou as mudanças de paradigma na ciência. A partir dessa constatação, a pergunta que procura ser respondida neste artigo é: a Justiça Restaurativa pode ser compreendida como um paradigma que subverte a lógica punitiva? Para responder a esta indagação, foi feita uma análise do paradigma punitivo e da proposta restaurativa como modelo de solução de conflitos, para, ao fim, concluir que, embora as práticas restaurativas operadas pelo Poder Judiciário brasileiro tenham funcionado como um gerenciamento de ilegalidades, os pressupostos teóricos da Justiça Restaurativa seriam capazes de promover uma rearticulação paradigmática e romper com o vício punitivo. | ||
| 520 | |a Given that the projects to reform the Criminal Justice System perpetuate, reproduce and reinforce the punitive logic, the researches that aims to solve problems that belongs to this structure can be classified as "normal science" studies, in appropriation of the expression developed by Thomas Kuhn, physicist and philosopher who studied paradigm shifts in Science. Based on this observation, the question that seeks to be answered in this article is: can Restorative Justice be understood as a paradigm that subverts the punitive logic? To answer this question, an analysis of the punitive paradigm and the restorative proposal as a model of conflict resolution was made, in order to conclude that, although the restorative practices operated by the Brazilian Justice System have worked as a management of illegalities, the theoretical assumptions of Restorative Justice would be able to promote a paradigmatic rearticulation and to rupture with the punitive addiction. | ||
