Summary:O presente artigo tem por desiderato tratar acerca do juiz das garantias e sua atuação no âmbito da Justiça Eleitoral. O texto propõe-se a analisar a experiência internacional de implantação do juiz das garantias e sua inserção no ordenamento jurídico brasileiro por meio da Lei n. 13.964/2019, cujos dispositivos pertinentes a essa figura processual encontram-se ora suspensos em decorrência de medida cautelar em ações diretas de inconstitucionalidade, a seguir abordando a estrutura e as atribuições da Justiça Eleitoral e as divergências existentes sobre a legitimidade do juiz das garantias nos processos criminais eleitorais. Método de abordagem hipotético-dedutivo, técnica de pesquisa bibliográfica.
The purpose of this article is to deal with the judge of guarantees and his presence within the scope of the Electoral Justice. The text proposes to analyze the international experience of implementing the judge of guarantees, its insertion in the Brazilian legal system through Law no. 13,964 / 2019, whose provisions pertinent to this procedural figure are now suspended due to a precautionary measure in direct actions of unconstitutionality, below approaching the structure and attributions of the Electoral Justice and the existing divergences on the legitimacy of the guarantees judge in the electoral criminal proceedings. Hypothetical-deductive approach method, bibliographic research technique.
