| 520 | |a Este artigo tem a pretensão de abordar a temática da responsabilidade na seara criminal, notadamente quando se relaciona à prática de atos lesivos ao Meio Ambiente, perpetrados por Pessoas Jurídicas. O direito ambiental moderno é composto por um conjunto de normas e princípios, que visam a proteção jurídica e preservação do Meio Ambiente. A conservação da natureza e dos recursos naturais se faz imprescindível para a continuidade da vida dos seres humanos no planeta. Esta proteção tem relação direta com a necessidade da exploração de parte dos recursos naturais pelo homem, como forma de subsistência na economia mundial (predominantemente capitalista). Nesse diapasão, através de um estudo de natureza bibliográfica, e através de pesquisa de metodologia documental qualitativa, serão abordados o conceito do referido instituto; a definição de dano ambiental; quais são os sujeitos processuais da relação jurídicaenvolvendo a responsabilização por crime ambiental; delimitados os princípios norteadores e indicados os demais aspectos legais, com base no que há de mais recente na doutrina e jurisprudência. | ||
| 520 | |a This article intends to address the issue of responsibility in the criminal field, especially when it relates to the practice of acts harmful to the Environment, perpetrated by Legal Entities. Modern environmental law is composed of a set of rules and principles, aimed at legal protection and preservation of the Environment. The conservation of nature and natural resources is essential for the continuity of human life on the planet. This protection is directly related to the need for the exploitation of part of natural resources by man, as a means of subsistence in the world economy (predominantly capitalist). In this tuning fork, through a study of a bibliographic nature, and through research of qualitative documentary methodology, the concept of the referred institute will be addressed; the definition of environmental damage; what are the procedural subjects of the legal relationship involving accountability for environmental crime; delimiting the guiding principles and indicating the other legal aspects, based on the most recent doctrine and jurisprudence. | ||
