Summary:O direito penal militar não é uma bolha imune às influências do seu tempo e espaço. Não obstante, a dogmática penal castrense insiste em produzir modelos autorreferenciados; hermética, portanto, aos reclamos da complexidade social que lhe é superior. A proposta do presente artigo é sugerir um rumo para atenuar a clivagem existente entre fato típico penal militar e a realidade da vida na caserna, valendo-se, para tal fim, do empirismo metodológico haurido da ciência criminológica. Busca-se, pois, uma oxigenação dialética, com o encontro entre a deontologia penal militar e uma ontologia criminológica que lhe seja consentânea, indicando os efeitos jurídicos e práticos que possam advir dessa comunhão.
Military criminal law is not a bubble immune to the influences of its time and space. Nevertheless, the dogmatic criminal military insists on producing self-referenced models; hermetic, therefore, to the complaints of social complexity that is superior to it. The proposal of this article is to suggest a way to attenuate the existing cleavage between a typical military criminal fact and the reality of life in the barracks, using, for this purpose, the methodological empiricism of criminological science. A dialectical oxygenation is sought, with the encounter between military criminal deontology and a criminological ontology that is consistent with it, indicating the legal and practical effects that may arise from this communion.
