AB El  presente  trabajo  tiene  por  objeto  el  esbozo  crítico  de  los  factores  históricamente  coadyuvantes de algunas de las principales etapas críticas de la Dogmática jurídico-penal. Dichas etapas críticos pueden ser reconducidas esencialmente a dos: el auge del positivismo, en particular el predominio del positivismo sociológico durante la segunda mitad del s. XIX, por un lado; y la irrupción de la Sociología funcionalista durante la segunda mitad del s. XX, como consecuencia de la extensión del pensamiento tópico, por un lado, y de la convicción de la necesidad de tener presentes  en  la  aplicación  del  Derecho  tanto  las  valoraciones  político-criminales  como  las  aportaciones de la Criminología y las demás ciencias sociales, por otro. En definitiva, se puede constatar  ya  la  presencia  ab  initio  de  una  disparidad  de  objetos  de  análisis  entre  Dogmática  y  Sociología penal. Con todo, ambas disciplinas mantienen un evidente punto de conexión.
AB The purpose of this paper is to provide a critical outline of the historically contributing factors to some of the main critical stages of the criminal legal dogmatics. These critical stages can  be  essentially  traced  back  to  two:  the  rise  of  positivism,  in  particular  the  predominance  of  sociological  positivism  during  the  second  half  of  the  19th  century,  on  the  one  hand;  and  the  irruption of functionalist Sociology during the second half of the 20th century, as a consequence of the extension of topical thought, on the one hand, and the conviction of the need to take into account both political-criminal evaluations and the contributions of Criminology and other social sciences, on the other. In conclusion, it is possible to verify the presence ab initio of a disparity of  objects  of  analysis  between  Dogmatics  and  Penal  Sociology.  However,  both  disciplines  maintain an evident point of connection.
