En general los tribunales no atribuyen relevancia al impacto del hecho en la víctima en la determinación de la pena de modo explícito, aunque hay indicios de que si se constata un impacto psíquico categorizado según criterios diagnósticos éste es tenido en cuenta, de modo consciente o no, para agravar la pena. La indemnización por daño moral es utilizada de modo generalizado para compensar los efectos que se presumen en los menores que han padecido abusos. La importación del modelo de los VIS sólo puede hacerse con cautelas, dados sus dudosos resultados en otros países, aunque son recomendables reformas y nuevas prácticas que permitan que los tribunales conozcan el impacto del hecho en las víctimas y se respeten los derechos de éstas a la justicia, la igualdad y la participación. | ||

In general, courts do not attribute relevance to the victim’s impact on the determination of punishment explicitly, although there are indications that the evidence of a psychic impact categorized according to diagnostic criteria is taken into account, consciously or not, to aggravate the sentence. Reparations for moral damages are widely used to compensate the presumed effects of crime on children who have been abused. Importation of the VIS model should be done with caution, given its dubious results in other countries, although reforms and new practices are recommended, in order to allow the courts to know the impact of the crime and that the rights of the victims to justice, equality and participation can be guaranteed. | ||
