Initially, the instruments in the international human rights system are determined, within which are guidelines, conventions, and rules of the United Nations; as well as the guidelines established in the Inter-American Human Rights System against juvenile delinquency. Subsequently, the antecedents regarding the protection of children and adolescents in the Brazilian and Costa Rican legal systems are studied, which facilitates a greater understanding of the Colombian legal system. It is concluded that in Colombia, despite the normative coherence of the Colombian legal system, it has not necessarily implied compliance with legal guarantees and international treaties. | ||
| 520 | |a Este texto describe los lineamientos desarrollados por el derecho internacional público y el nacional en materia de responsabilidad penal para adolescentes. Inicialmente, se determinan cuáles son los instrumentos en el escenario internacional de los derechos humanos, dentro de los cuales se encuentran directrices, convenios y reglas de la Organización de las Naciones Unidas (ONU); así como las directrices establecidas en el Sistema Interamericano de Derechos Humanos (SIDH) frente a la delincuencia juvenil. Posteriormente, se estudian los antecedentes en materia de protección a los niños, niñas y adolescentes (NNA) en el sistema jurídico brasileño y costarricense, lo cual facilita la comprensión del sistema colombiano. Se concluye que, en Colombia, a pesar de la coherencia normativa del ordenamiento, no se ha generado necesariamente la materialización de las garantías legales y de los tratados internacionales. | ||
