AB The article deals with the basis and content of the duty to cooperate in the maintenance of a state of liberties as a central concept of criminal law. On the one hand, it analyzes its requirements and scope. On the other hand, it studies possible responses to citizens who cannot be considered as suitable recipients of this duty and against whom, therefore, it is not possible to raise a criminal reproach in the strict sense.
AB El artículo se ocupa del fundamento y contenido del deber de cooperación en el mantenimiento de un estado de libertades como concepto central del Derecho penal. De una parte, se analiza cuáles son sus requisitos y alcance. De otra parte, se estudian posibles respuestas frente a los ciudadanos que no pueden ser considerados como destinatarios idóneos de dicho deber y frente a los cuales, por consiguiente, no es posible elevar un reproche penal en sentido estricto.
