AB Polizeiliche Befugnisnormen zur Personenkontrolle an „gefährlichen Orten“ unterliegen wegen des entgrenzten gesetzlichen Tatbestands und der damit verbundenen Ausweitung polizeilicher Definitionsmacht rechtlichen Bedenken. Der Beitrag greift diese Kritik auf und legt dar, dass die Definition „gefährlicher Orte“ zu einem erhöhten Kontrolldruck gegenüber People of Color führt und Praktiken des „racial profiling“ begünstigt. Die verschiedenen Ansätze zur rechtlichen und polizeipraktischen Einordung des „racial profiling“ werden diskutiert und es wird argumentiert, dass eine Verdachtsgewinnung in Anknüpfung an die Hautfarbe weder gesellschaftlich hinnehmbar noch rechtlich legitimierbar ist. Abschließend zeigt der Beitrag einzelne Wege auf, mit denen sich die negativen Auswirkungen der Befugnisnorm zur Personenkontrolle an „gefährlichen Orten“ minimieren lassen.
AB Due to their legal vagueness and the associated expansion of police discretion, police powers to stop and question are subject to legal concerns. This article takes up this criticism and explains that the definition of ‘dangerous places’ leads to increased stop and search pressure on people of colour and favours racial profiling. The various approaches to the legal and practical classification of racial profilingare discussed and it is argued that suspicion based on skin colour is neither socially acceptable nor lawful. Finally, the article  points  out  individual  ways  to  minimise  the  negative  effects of the authority norm for identity.
