Then, I specifically address the problem of the legitimacy of a duty of protection whose fulfillment requires in the specific case to kill a citizen. Can a criminal law system that claims to be liberal force police officers to shoot a citizen to death? This paper concludes with a final section devoted to condensing the main theses defended in what follows. | ||
| 520 | |a ¿Puede el deber de garantizar la seguridad ciudadana o de prevenir delitos demandar a un agente de policía el recurso a la fuerza letal, quedando el homicidio doloso del agente justificado en cumplimiento de un deber? A responder a esta pregunta se dedica el presente trabajo. Para ello, se analizan primeramente los presupuestos de legitimación de los deberes policiales cuyo cumplimiento demanda el recurso a la fuerza penalmente típica. Acto seguido se aborda específicamente el problema de la legitimidad de un deber de protección policial cuyo cumplimiento requiere en el caso concreto acabar con la vida de un ciudadano. ¿Puede un ordenamiento jurídico-penal que se dice liberal obligar a los agentes de policía bajo amenaza de pena a disparar mortalmente a un ciudadano? El presente trabajo concluye con un último apartado dedicado a condensar las principales tesis defendidas en lo que sigue. | ||
