One of the novelties worth noting among those introduced is the abolition of the substitution of the sentence of imprisonment set forth by article 88 of the Criminal Code and the introduction, in return, of an exceptional form of suspension of execution of imprisonment that entails the mandatory imposition of measures that are punitive in nature—fines and community sentences. These measures may also be imposed on the other forms of suspension. This work offers an analysis of the repercussions of these changes in the foundations and configuration of the suspension of execution (articles 80 and following of the Criminal Code), with special attention paid to the study of the above-mentioned exceptional case of suspension. | ||
