In spite of this, a broad sector of jurisprudence warns of a contradiction between this provision and the constitutional principles that support the Social State of Law. This article has a legal-reflective nature, which is approached from a qualitative research with bibliographic review, has as its main objective to describe and analyze this debate, and to assume a guaranteeing position, agreeing with those who propose that, in the context of judicial discretion, the power for the judge to order the practice of evidence ex officio, exceptionally, should not be restricted, since the judge is the director of the process, and it is up to him to determine the specific circumstances in which he appeals to this possibility, in the interest of material justice. | ||
| 520 | |a El ordenamiento jurídico colombiano prohíbe al juez penal la práctica oficiosa de pruebas, en aras de preservar el formalismo procesal y la imparcialidad del juez dentro del proceso. Pese a ello, un amplio sector jurisprudencial advierte una contrariedad entre esta disposición y los principios constitucionales que soportan el Estado Social de Derecho. Este artículo de carácter jurídico – reflexivo, el cual se aborda desde una investigación cualitativa con revisión bibliográfica, tiene como objetivo primordial, describir y analizar ese debate, y asumir una postura garantista, coincidiendo con quienes proponen que, en el contexto de la discrecionalidad judicial, la facultad para que el juez ordene la práctica de pruebas de oficio, de manera excepcional, no debería ser restringida, toda vez que el juez, es el director del proceso, es a él a quien le corresponde determinar las circunstancias concretas en las que apele a esta posibilidad, en aras de una justicia material. | ||
