Summary: | Multiple perpetrator sexual assaults have been part of our criminal reality since immemorial times, despite the recent interest this criminal spectrum has aroused in recent yearsin our country. After an epidermal description of the state of sexual violence in Spain and abrief theoretical approach to the most outstanding characteristics of the doctrine on thisphenomenon, the response of the criminal justice system is analysed in terms of the applicationof art. 180.1.2 of the Criminal Code from a criminological perspective. This section refers tothe joint action of two or more persons as an aggravating circumstance . A quantitative andqualitative study of judicial sentences handed down by various Spanish Provincial Courtsbetween 2005 and 2020 is thus offered, in which a myriad of diverse variables are examinedwith the aim of offering a profile for the multiple perpetrator sexual assault in Spain. The study,based on 244 cases (159 convictions and 85 acquittals) and 449 defendants (271 convictionsand 178 acquittals), establishes the relevance of aspects such as the youth of the aggressors, theabsence of a previous relationship with the victim or the partial prosecution of these groups,among other extremes. |
