Summary:The overrepresentation of young foreigners in juvenile prisons is a fact that has been noted in the Spanish criminological literature. Various arguments can be put forward to explain this phenomenon. This article aims to contrast the different explanatory hypotheses of this overrepresentation with the data available, dividing the hypotheses into those based on the criminal behavior of foreign minors and those that focus on the activity of the Juvenile Justice Criminal System. For this purpose, official data about police arrests and convictions are used with secondary data obtained from previous research. The study and contrast of these data allows us to affirm that the criminal behavior of foreign minors is an insufficient element to explain their overrepresentation in juvenile prisons. This suggests that the biased activity of the Juvenile Justice Criminal System on these minors plays a relevant role on those detention rates.
