Das republikanische Sicherheitsmodell steht für Zentralismus, Repression und Ordnungspolizei, sowie traditionelles, am Schuldprinzip orientiertes Strafrecht. Das liberalistische Sicherheitsmodell steht für Dezentralisation, Prävention und Sicherheitspolizei, sowie postmodernes, am Risikobegriff orientiertes Strafrecht. Im pasquaschen Rahmengesetz zur inneren Sicherheit (loi d'orientation et de programmation rel. a la securite) ist die Kontradiktion beider Modelle gleichsam dialektisch aufgehoben. Das Gesetz ist nicht nur Spiegelbild der gesamten sicherheitspolitischen Entwicklungsgeschichte Frankreichs, sondern auch beispielhafte Darstellung dessen, was die typisch französische Variante des mit dem Rüstzeug der Postmoderne aufbereiteten Rechtspositivismus des 19. Jahrhunderts ist. | ||
| 520 | |a The history of French security-politics and practice reveals the contradiction of two mainstreams. On the one hand there is the trend of the so called republican security model, on the other hand we have the trend of the liberal security model. The republican model means centralism, repression and order-policing as well as traditional criminal law based on the principles of guilt and penal responsability. The liberal model has to be associated with decentralism, prevention and security policing as well as postmodern criminal law based on the principles of risk and negligence. The Pasqua law of security-program and organization of 21.Jan.1995 surmounts in a special dialectical way the contradiction between these two models. The so called „loi d'orientation et de programmation relative a Ja securite" is the mirror in which France reflects its whole history of security politics. But it is also an exemplary illustration of what may be considered as the very French variant of postmodern styled nineteenth-century-law-positivism. | ||
