Der Beitrag stellt drei Aspekte einer kulturwissenschaftlich-interdisziplinär angelegten Studie zum Thema der sexuellen Gewalt vor. Dabei geht es im Wesentlichen darum, literatunvissenschaftliche Theorien und Methoden auf die Lektüre juristischer und kriminologischer Texte anzuwenden, die sich mit dem Modus von Erzählungen und der diskursiven Herstellung von Glaubwürdigkeit beschäftigen. Im ersten Abschnitt geht es um die problematische Stellung der Frau als Zeugin im juristischen und anderen kulturellen Diskursen. Der zweite Teil beschäftigt sich mit dem prekären Status der Rede traumatisierter Zeugen und stellt eine Beziehung zwischen den von der Aussagepsychologie entwickelten Glaubwürdigkeitskriterien und einer Poetik des Realismus her. Der dritte Abschnitt widmet sich der Bedeutung des Vorstellungsvermögens im Kontext richterlicher Urteilsfindung. | ||
| 520 | |a lf we agree that testifying is a performative act and that credibility is produced within certain discourses we might be able to locate some of the discursive factors which have possibly contributed to the problematic status of female witnesses and to the crisis of women's credibility in rape trials. The following article presents three aspects of the discursive representation of sexual violence with reference to the law-and-literature-debate. One of the main aims is to show how literary theory can be useful in the analysis of legal texts concerning the discursive practice of witnessing and assigning credibility. The first part discusses the reservations against women as witnesses in legal and other cultural discourses. In the second part the problematic status of traumatic speech will be examined with respect to the fact that legal criteria for establishing credibilty seem to resemble the principles of a literary tradition, i.e. a poetics of realism. The last part attempts to describe the function of imagination in the process of legal judgment. | ||
